1. Introduction
Welcome to Techtoil. These Terms and Conditions govern your access to and use of Techtoil’s WhatsApp Business API software, platform, and related services.
By registering, accessing, or using our services, you agree to be bound by these Terms. If you do not agree, you must not use the platform.
2. User Responsibilities
• Users must use the Techtoil platform only for lawful and legitimate business purposes.
• Users must strictly follow Meta’s WhatsApp Business Platform policies, guidelines, and acceptable use standards.
• Any form of fraudulent, deceptive, misleading, spam, or abusive marketing practices is strictly prohibited.
• Users are solely responsible for the content, messages, and campaigns sent through their WhatsApp API account.
3. Account Registration & Security
• Users must provide accurate, complete, and up-to-date information during account registration.
• Users are fully responsible for maintaining the confidentiality of their login credentials.
• Any unauthorized access, security breach, or suspicious activity must be reported to Techtoil immediately.
• Techtoil will not be liable for losses caused by unauthorized account use due to user negligence.
4. Payments, Billing & Subscription
• Users agree to pay all applicable setup fees, subscription charges, and usage fees as per the selected plan.
• Payments must be made on time and through approved payment methods.
• Failure to pay dues may result in temporary suspension or permanent termination of services without prior notice.
• Fees once paid are non-refundable, unless explicitly stated otherwise in writing.
5. Data Protection & Consent
• Users are responsible for obtaining explicit consent from end-users before sending WhatsApp messages.
• Users must comply with all applicable data protection and privacy laws, including local and international regulations.
• Techtoil acts only as a technology service provider and does not control or manage end-user data collected by its users.
6. Compliance with Meta (WhatsApp) Policies
• Users must strictly comply with Meta’s WhatsApp Business Platform policies at all times.
• Any violation of Meta policies, including spam, opt-in misuse, or prohibited content, may lead to:
o Account suspension
o Message blocking
o Permanent termination of API access
• Techtoil is not responsible for actions taken by Meta due to policy violations by users.
7. Service Availability & Limitations
• Techtoil strives to provide uninterrupted service but does not guarantee error-free or continuous availability.
• Services may be temporarily unavailable due to maintenance, upgrades, or technical issues.
• Techtoil shall not be held liable for delays or disruptions beyond its reasonable control.
8. Termination of Services
Techtoil reserves the right to suspend or terminate user access if:
• These Terms are violated
• Meta policies are breached
• Illegal or unethical activities are detected
• Payments remain unpaid
Termination may occur without prior notice in serious violation cases.
9. Limitation of Liability
• Techtoil shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform.
• Users use the services at their own risk.
• Techtoil is not responsible for business losses, data loss, or Meta account bans caused by user actions.
10. Changes to Terms and Conditions
Techtoil reserves the right to modify these Terms at any time. Updated Terms will be posted on the website. Continued use of the platform indicates acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India, subject to the jurisdiction of competent courts.
